When I worked as a service tech I once had to deal with a laptop full of porn. The owner was rather fond of one particular means of sexual expression. I got the impression the guy handed it over to the only female tech for a reason. If so, it was a definite case of epic fail.
@zanzibarlegend: I love the banhammer as much as anyone else but after reading Super Sonic's posts, I don't see where he is advocating CP at all.
He seems to be saying that it can't be illegal if a simple search easily brings up URLs and images. I think search engines remove any content that is deemed to be CP-related.
Is that a chance anyone should be taking? No.
Is there a reason people should have nude photos of the under-aged? As far as I can tell, no.
On a slightly unrelated note, look at the child beauty pageants and [what I deem to be] provocative clothes at children's clothing stores and the fact that sex is being used to sell ALL kinds of items in this country and all over network television but then the human body is pretty much demonized at the same time.
I believe that creates an environment for people to repress their urges and those urges mutate into unnatural desires.
Of course, there is no defending the offenders but everyone must look at all contributing factors to try to rid society of ills such as this.

@Dr. Evil Genius: he doesn't explicitly speak of his likeness for it, but his comments imply condoning such an action. he's trying to take the issue out of context by adding silly variables.
i personally have pics of my son when he was a baby getting bathed... and thats it. i dont need to be taking pics of him when he's 10 or 13. not even for fun... simply because
1) i have no reason to do so
2) the type of implications that would cause
im sorry but "10-13 year old girls sounds like plural to me. and the word explicit is a red flag. this guy could just be surfing for CP, but he could also be a potential Predator. its best they investigate and find out if he got the pics off the net, has he chatted online, or solicited and child.
my point is, the Apple Genius Bar Employee might have saved some kids from a harrowing experience they will never forget.
so for super sonic to come on here and try to explain the gray area is just downright ridiculous to say the least.
we don't live in an utopian society were everything can be up for debate or can be generalized... particularly when it comes to CP. CP is clearly defined. most folks on here are well educated on the issue, so don't mind the hatefest.
So, BestBuy does it, and gets sued. Apple does it and gets praised. I guess that means we'll start to see a huge migration of geeks to geniuses. That way they can troll for pr0n all they want with no fear of getting caught.
Manager: Geeknius, what do you think you're doing?!?
Geeknius: Oh, uh, well... I'm just checking to make sure this guy isn't a pedophile!
Manager: Oh, excellent! Keep up the good work!
@BenjaminCachimbear: There's a difference. The Geek Squad guys were taking porn off of customers computers and using it for their own enjoyment (probably private pictures taken by consenting adults), and also stealing music, movies and other stuff. The apple store guy found illegal pictures and did the correct thing: notify the police and get the sick bastard arrested.
having worked in that store, I can tell you that it is way too busy of an environment for anybody there to casually just browse people's systems. Regardless, if illegal content is on a customer's computer, and it is uncovered by the person working on it (whether it be apple, Geek squad, etc) it is probably a mandate (and at least ethically moral) to report it.
so, when it comes to child porn and terrorism, privacy does not exist? Please explain to me how snooping through someone's files before the snooper has any hard evidence that their content is criminal justifies a breach of privacy.
Yoo-hoo, another felon found. However, yoo-hoo not too much, when the videos of you and your girl-friend doing the nasty are all of the sudden all over the internet after you brought in your laptop for a repair. And that goes just for more delicate information. I don't want anybody to read my files, full stop.
@yogibimbi: His computer was having problems opening image files, he brought the computer to an apple store to fix it, the tech guy was testing the computer by opening images...
You don't want anybody looking at your files? Back them up before you bring it to repair or keep them in an external hard drive.

It's not like the apple guy broke into his house, logged on to his mac and went digging for dirt. The other guy brought his computer in for repair and handed it over to the apple employee.
When he did that Apple had full rights to check whatever files relevant to his technical problem (images). They do have a confidentiality agreement but that doesn't extend to anything of a criminal nature.
You can't complain about privacy if you invite a plumber into your house to fix your bath and he finds a dead body in it. It's your own fault for not moving it in the first place (and comitting murder of course).
"pictures of naked 10- to 13-year-old girls in "explicit" poses" is NOT child pornography! There are 100% legal "nude modeling" websites all over the internet for anyone to join. Unless there is a sexual act being depicted, its not pornography.
@Kaiser-Machead:
I'm pretty sure the only pseudo-legal crap anywhere close to this are non-nude sites, and even those are getting shutdown on a regular basis when Nancy Grace (d-bag but not for this) or somebody else on cable news decides they can make a buck going after them.
@Super Sonic: What an epic, epic fail on your part, just because there are no clearly defined legal definitions of what child pornographic images are does not mean they are legal.
Most possessors of child pornography who are arrested are found to possess images of prepubescent children; possessors of pornographic images of post-puberty minors are less likely to be prosecuted, even though those images also fall within the statutes.
Any image of a child in a provocative pose is deemed as child pornography and this guy can and will be prosecuted severely for his folly.
Sir you are as bad as the paedophiles and need a serious dose of reality. The fact that you are aware of the nude modeling sites that these pictures can be downloaded from is very worrisome and I don't think you have any business posting here.
I always hear about guys like him getting busted for possessing child porn.
But, what I never hear about is any of these "studios" that are taking the pictures of these kids. What about the photographer, or the PARENTS of the kids? Someone is taking the kids to be photographed. An 8 year old doesn't walk in off the street and decide to become a model.
Are they all outside the US and cannot be prosecuted?
Child porn is horrible, I don't disagree. But which part of it is worse... the viewing of the pictures by some guy in Connecticut... or the taking of the pictures by some guy who is making money from them?
@Super Sonic: I'm not going to bother making a thought out post like some of the other people I'm just going to go with: Fuck you, you sick fuck for even trying to defend that.
@Super Sonic: Uh-huh. Good luck arguing with a judge over the artistic merits of the photographs. And then, when the judge does refuse to throw out your case, let's see how a jury feels about the nature of the photographs.
@Michael Scrip: Well, just like the drug thing, it can be argued that without the consumers, the creators and dealers wouldn't be in business. However, I suspect those who produce child pornography are also consumers of it, so that argument is pretty weak.
But as in anything, it's easier to cast a wide net and capture a bunch of the consumers of porn. You'll capture hundreds of consumers with the same resources you'd have to commit to capture one (usually anonymous) producer, since there are likely hundreds of consumers for every producer in the first place. A small handful of people producing large amounts of child porn could probably feed the entire consumer base, so it's a bit of a needle-in-a-haystack thing. Plus, the ones who suck at covering their tracks get caught in no time, the more cunning producers can probably get away with it indefinitely.
Sadly, these days a "studio" can consist of one half-decent DSLR and the corner of someone's garage or basement, and the distribution medium is huge and can't be readily contained.
That said, those who produce child porn are caught periodically, but usually because someone, somewhere recognized their victim, or the victim came forward and revealed their abuse.
@Super Sonic: How do you KNOW they weren't kids bent over a table with their 'goods' spread? If that's your ideal of 'art', you deserve to get around 5 years with this guy.
And there aren't legal nude modeling websites for underage kids. Don't be stupid.
Art, yes. But that's painting and photoshops without a real child.
@Super Sonic: 1) site's down, good job letting the feds know.
2) saw a cached version, and i must say it's disturbing. it's like saying saying swimsuits aren't suggestive but when i look at tyra banks it's usually with a bottle of lube and a box of tissue.
3) you sir are a sick fuck.
4) legal or not, forcing any child to do that kind of work is just wrong. i don't see how that's any better than working in a coal mine or a meat processing plant in the 1900s.
@Super Sonic: O rly? "Lascivious exhibition of the genitals or pubic area of any person [is defined as child pornography under federal law (18 U.S.C. §2256)]."
Plus law enforcement doesn't give a shit. You're a scumbag to everyone else already, so be ready to be treated like one.
@Super Sonic: I certainly will not search "two-cute" (why would one search that?).
The way you insist on telling us it's 100% only makes me believe that it is not.
Begone with ye, and if I had admin priviledges, I would have disemvolweled your comments, and banned your account. And if possible, forwarded your IP address to the FBI.
@Super Sonic: "Unless there is a sexual act being depicted, its not pornography."
So, by your logic, in theory, one could pull a random child off the street, have them get naked, then jerk off to the naked child, and everything would be kosher? There's absolutely nothing wrong with that? You sick, sick son of a bitch. Die.
@alexmetal: S**t. I approved your comment and now the whole thread is attached to my name. It says that I approved S*** S*** first comment! WHICH I DIDN'T.
Things like this make me mad about the new commenting system.
IS THERE A WAY TO DELETE THIS WHOLE TREAD, GIZMODO? It is really unnecessary.
@alexmetal: Who is taking kids off the street and jerking off to them? These are pictures, the kids are genuinely (not forced) smiling and their parents are supporting them.
@max11221: Nude doesn't mean sexual. Look at art. Paintings of Cherubs, and other child like flying beings, mothers with child, children in fields playing, etc... Nudity is prevalent in paintings, and is of a nonsexual nature.
The idea that nudity is sexual only is a horrible concept. Is it sexual to take a shower in the morning? Or to be pre-clothed thereafter? Plenty of parents have pictures of their children naked, running around, being children. They don't have child pornography.
Child pornography is a problem.
If an artist wants to depict a nude child form, for non sexual purposes, with the consent of the child and their parents, that is their business.
Artistic Nudes are Art. People can use them for sexual purposes but they are not made for that purpose. In the same way that anything that isn't a weapon, can be used as one.
@Super Sonic: You are a sick demented person. When you have a kid one day, which I really really hope you never do, how would you feel if there were nude pictures of her/him online you sick fuck?
There are an awful lot of people coming to snap judgments and absurd levels of hate with absolutely zero evidence that Super Sonic has actually done or is doing anything morally, ethically, or legally wrong.
Fortunately, this would seem to be par for the course on the Internet.
@angelzero: Morally wrong? He is defending nude pictures of children. I don't care what your reasoning is, it will NEVER be acceptable to defend something like his. He should except this kind of reaction and so should you. This thread should be deleted, it disgusts me.
@macpatrick: What about nude pictures for medical reasons? Or photos of your kids in the bathtub? Or nudists and naturists, all of their photos are naked, and, most, of a non sexual persuasion. Nudity doesn't equal sex.
@Conrad: In context all of those pictures could be pornography. Is a picture of your child in the tub porn? No, clearly it is not. If someone is downloading that same picture off the internet for there sexual satisfaction pornography? Absolutely.
And I agree nudity does not equal sex. Nudity can be beautiful. But in this context, those rules do not apply. And defending someone having these pictures of young girls, knowing the circumstances, is something that disgusts me. And I HOPE it disgusts you too.
@macpatrick: Yes, but to say that in all cases that nude pictures of children are pornographic, and as Kabuk1 said people need to be shot in the face for having them, is a blanket statement that condemns many that are not breaking any laws. Under these blanket statements parents everywhere should be shot in the face.
So how did the Apple guy find the pictures? Was there a big folder on the desktop called "NUDE CHILDREN XXX PORNO" or something like that? Because unless they were snooping around in his files, those pictures must have been in a pretty visible place.
@Hello Mister Walrus: He was having problems viewing images. The contract you sign with apple states we can technically see any and everything (confidentiality means we won't steal/sell/leak your info, not that we won't see it), and that we will likely look at things relevant to or causing your technical problem. Having image troubles? Delete bad images, c'mon think!
Edit: Also, when transferring data, when importing an iPhoto library, each photo flashes on screen while it is imported. Usually, this is annoying and we minimize it while working on something else, but if images were the computers problems, I could see how the cp was discovered this way also.
@(Starman) AnalysisDialysis: They would have installed "antispyware" and charged him extra to replace his RAM, and suggested he sign up for a service plan.
