    Itunes already supports several other media players besides iPods last I knew. But selling a product that defeats... Well, that strikes me as illegal. Whether we like the law or not.


    But, then again the city losing millions of dollars of ad revenue from Apple may certainly have something to do with it. However I personally find his placement of advertisement distasteful. It's a bit like wandering into your competitor's store wearing your Best Buy shirt and talking to the customers there.

    Sounds like a administrative law case in the making. I don't know what procedures California has for reviewing these determinations but here in NY, this smacks of an "arbitrary and capricious" determination.

    Was there an ad there before? I think I remember that there was just glass and you could see the escalator etc. from the outside. BART could have just taken it down for being opaque and blocking out the natural light.


    But yeah, I don't really believe that. If it really violated some sort of BART requirement, I doubt that it would have been approved in the first place.

    If Apple called and said we love the ad, and think you should put it up where all our ads are, because we're leaving, and taking our money with us, what do you expect the folks at BART to do?


    Sucks that the little guy gets screwed, but it would make sense for Apple to flex their shiny, minimalist, unibody muscles.

    @Jim Topoleski: BART is also a municipal entity that has opened a forum to free speech. While commercial speech does not enjoy all of the protections of the First Amendment, it is protected speech nonetheless. This appears at first blush to be a violation of the Equal Treatment Principle of the Fourteenth Amendment.

    @DefineStatutory: Sell that ad space to someone else? Apple couldn't give up that ad space, the company is entirely based of marketing so I doubt they would reduce it over a spat like this.
