    I seriously hope Google allows these peace talks Cyanogen is trying to get open. Because this is seriously not cool news.

    Could be that they're just doing it for the token "defense of patent" angle. I know that if you don't put up enough of a fight over trademark infringement you can have your trademark revoked outright by the courts (happened to Bayer with a brand known as "Aspirin").

    No, the Rollerblade company still holds the trademark on the name "rollerblade", though (like "kleenex", "band-aid", and "coke") it is often misused in casual conversation. The proper generic name in this case is in-line skates. In the case of "aspirin", the US courts actually revoked Bayer's trademark, legally allowing anyone to call that chemical compound "aspirin". You can't buy generic Tylonol, but you can buy generic aspirin. That's actually the only case I can think of where a company so lost control of their own trademark that it is no longer even associated with them.

    The short version is that Apple has in fact tried to argue that jailbreaking is illegal and violates the copyright on their bootloader and few other tools. Essentially, it's their only viable legal leg to stand on to completely shutdown jailbreaking.

    We should actually be looking to see the results of this debate in the coming months. Exciting.

    Oh Noes! I was feeling some hatred toward my G1 because of the constant performance issues, constant battery issues and the news that the g1's limited memory could prevent it from getting the donut update.

    Then I rooted my phone with cyanogen's G1 rom in July and it's disgusting how much better his rom runs than Googles own cupcake 1.5 update. Google needs to stop being pussies considering their own legal speak makes no damn sense considering Cyanogen ONLY works on the devices they mentioned (as far as I know) and just give him a job. He's done what Google coulda/woulda/shoulda done but didn't...made the G1 a viable contender in the face of the palm pre and iphone with better performance. The improvements my g1 has gained because of Cyanogen's ROM can't be understated. If the worse case scenario pans out and his ROM is killed, then to hell with the g1. I'm not going back to a shitty legit build after having the bliss of a rooted phone with a kick ass ROM.

    Leave him alone Google, just leave him alone...his work is for the good of the G1 and MyTouch community...

    @Shane Peden: No you don't lose your paid apps. Once they're purchased you can download them as many times as necessary, free of charge (if this has changed someone chime in and let us know). You'll have to download your themes, fonts, and icons again as well or just back them up on sd card using Astro File Manager.
    Also, if you want to run apps2sd (apps from SD card to free up internal memory) you'll have to partition your sd card to make it work (I recommend Paragon Partition Manager 9 Trial version). But what is cool about Cyanogen's 4.0.4 ROM is that once the card is partitioned it will automatically move your apps to the sd card and any future apps will all be saved to SD card.

    Check Google or Bing for the G1 Recovery Flasher which should still be on the interwebs (used to be in the market) and you can root you phone in 30 seconds. You can also backup your legit build (1.5 img) to SD card with all of your settings and customizations intact. So if you root and don't like it, you can undo it.

    Sounds like a misunderstanding? If it can only be installed on phones which already have the Google Apps pre-installed then it doesn't sound like he's even dealing with the source code at all, just linking to them and launching them from his portal, which is fair use and I seriously doubt Google in its right mind would contest it (especially considering the fact that Android is supposed to be a "free", "open-source" system).

    Or am I missing something here?

    I ditched my 2G iPhone for an unlocked G1 because the rom dev community was supposedly legitimate and devs could spend more time making better roms rather than playing cat and mouse with the manufacturer. I hope that Goog will come up with a workable solution. All those former iPhone developers won't stick around to make nice apps if they start pulling the same caliber crap.

    except that you can install this rom on iPhones, which I've heard more people about using this for. And Agent_M on twitter, with over a million users listening, isn't exactly quiet about using it, which is how someone at google heard about it.

    @Sam Scott Given: Your comment is full of fail. Cyanogen's mods are replacement firmwares for Android, which hasn't been ported to the iPhone. And Google doesn't need to follow someone on twitter to know about Cyanogen, as he's famous enough to have a spot on the Android Wikipedia article.
