18. On information and belief, persons other than Psystar are involved in Psystar’s unlawful and improper activities described in this Amended Complaint. The true names or capacities, whether individual, corporate, or otherwise, of these persons are unknown to Apple. Consequently they are referred to herein as John Does 1 through 10 (collectively the “John Doe Defendants”). On information and belief, the John Doe Defendants are various individuals and/or corporations who have infringed Apple’s intellectual property rights, breached or induced the breach of Apple’s license agreements and violated state and common law unfair competition laws. Apple will seek leave to amend this complaint to show the unknown John Doe Defendants’ true names and capacities when they are ascertained.

In other words: There's somebody else behind Psystar. Someone who is worth prosecuting by Apple's mighty lawyers. Groklaw says that this is important because it may explain why Psystar has been ignoring Apple and continue to boldly sell their crappy PCs running Hackintosh, a hacked Mac OS X version that runs in generic Intel hardware.

Apple is also asking for a preliminary injunction against all Psystar activities related to Mac OS X. Groklaw speculates that the people and corporations behind Psystar may be important and that, when Apple finally identifies them, they will obliterate them. [Groklaw via MacRumors]

<![CDATA[Mac Clone Maker Psystar Says Apple's EULA Violates Monopoly Laws, Wants to Challenge it in Court]]> Psystar, who's just announced that they're going to sell a $399.99 Mac clone called Open Mac, doesn't care that Apple's EULA prohibits using OS X on any machine not made by Apple. In fact, they say that Apple's terms "violate U.S. monopoly laws", posing the example of Microsoft theoretically saying you could only install Windows on Dell machines.

They also told Information Week that they weren't breaking any laws, and that they were going to continue to sell this system no matter what Apple says. Another example the employee gave was this: "What if Honda said that, after you buy their car, you could only drive it on the roads they said you could?" Even if Psystar's machines aren't anything spectacular, if they can set a legal precedent for third-party manufacturers selling OS X-bundled machines, that would be a win for everybody. We like our MIRTs here at Gizmodo. A MIRT—Mobile Infrared Transmitter—is a device used by law enforcement and ambulances to turn red lights green. While it would undoubtedly be fun to possess such a device, getting caught with one will turn your world upside down. Not only can Traffic Control register which car the infrared transmission comes from, but supposedly some city law enforcement vehicles are equipped with MIRT-detecting devices. Of course, you could always drop a few bucks (or 400) on the Stealth EVP and be immune to all detections, but hey, we re all honest citizens here, right?
