Or is it like the iPhone 3G, where either way, you have to have the $30/mo data plan, and if you don't and they catch on, they change it on you?

No. Giz failed to mention an important fact about this: Any smartphone or feature phone activated after this date, regardless of if you have a plan with them now, will require a data plan. And it isn't that the reps won't do it; the system WILL NOT allow the rep any other option besides adding the data. If they don't add the data plan, the phone cannot be activated.
