Not everyone who got banned was a bona fide pirate. Plus there was a bunch of people who got gouged because they bought 2nd hand 360s at the time and found they were banned. Thirdly this is a news blog and this is news. Finally this is Gizmodo and not Kotaku. #bannedxboxworkaround

The people that this sucks for are the ones who were playing around with extended media-functions and home-brew.
Someone with some money and a black-listed XBox seriously needs to file a challenge against the DMCA on this. AFAIK there isn't any case law surronding the "right to tinker". All the criminal prosecution I've seen for modded consoles has been based on the no reverse engineering clause in the DMCA.
The fact that the DMCA exists at all goes to some deeper societal issues that I won't go into here lest steam start escaping from my ears... #bannedxboxworkaround

Microsoft has the right to define what hardware or software can interact with it's service. It is also a right of theirs to suspend or ban access to any console or user who violates the legal contract to which they agreed to.
While I agree, there are people hurt by this measure which did not in any way do anything to tamper with, mis-use the service, or play unauthorized or pirated games, the blame for this "lockout" is not on Microsoft but on the people who did gamerscore/achievement cheat, and who did play pirated games.
People can still have modified Xbox 360's. They can still use them for MCE's. They can even still get their systems updated (you can still burn updates to CDs). The only thing they won't be able to do is use those consoles to connect to Xbox LIVE.
Microsoft isn't preventing anyone from modifying their consoles. They are preventing modified consoles from connecting to Xbox LIVE. #bannedxboxworkaround

um, should i be concerned that the neighbor kid just came over to use my buddies xbox to change his gamertag? i'm positive he's a modder, so it only makes sense that his actions are in relation to the massive ban... #bannedxboxworkaround
