    This is ridiculous. How do you tell your customers that you are screwed so easily? This is like saying, "We don't care about you. This system is banned, and it will stay that way."

    @hcho3: How is this any different than any other nontransferable warentey?

    How is this any different than buying a used car that turns out to be a lemon? It's not the responsibility of Honda to ensure the car still works, that's up to the reseller. #xbox

    Despite the official "warranty is not transferable" policy, Microsoft still fixed the 360 I purchased used when it RROD'd. They'll make an exception for things that are their fault.

    Things that are YOUR fault on the other hand... #xbox

    ...and here's another reason why I bought a PS3 instead. Call me silly, but I think the primary purpose of a game console is to work.

    buying anything used has always been a problem. Even in the old days, the Romans would demand a warranty on their x boxes....thus the saying "caveat emptor" #xbox

    Check the comments on Major Nelson's site for a little more insight. Less-than-shady party means anyone you don't personally know.

    Gamestop doesn't check if their consoles work, let alone whether they've been banned from Xbox Live, so any used console from Gamestop would run this risk.

    But then again, I've never really supported Gamestop's used sales. Developers get the same money from pirated games as used games, so whats the difference? You're not supporting them in either case. #xbox

    Just go the whole distance and declare that libraries should be burned to the ground because authors only get one sale for an unlimited number of readers.

    While you're at it, educate yourself on the First Sale Doctrine.

    @Guard: Developers DO get paid for used game sales. Please learn some economics.

    Knowing that you have the option to take a game back to Gamestop (or elsewhere) and get some money for a trade-in adds value and increases the chance of the original purchase. Studies show a significant amount of new games sales at places like Gamestop come back as a trade-in a few weeks later and that person buys the next new release. You think all those people buying the new release would buy as many games without being able to trade-in those they didn't really want to hold on to? #xbox

    I wonder if there's a way to flash the bios/MAC address (or whatever M$ uses to id the xbox). That would be kinda a neat experiment.

    Not that there's a huge market for re-enabled xbox 360's. And it would probably take forever. But it would be kinda cool. #xbox

    @newgalactic: They did that with the first-gen XBox. Need to unban your console? Swap the EEPROM and hard drive from another console. (the hard drive unlock key is in the 'PROM so you have to swap the drive with it, too. #xbox

    My unmodded 360 is still hardware banned. I doubt microsoft will have any amnesty because it was opened to install better cooling for RROD prevention. Meh. #xbox

    Hardware banning is total bullshit. It ensures that the resale value of the consoles go in the toilet, and in turn makes for a greater amount of sales of new hardware. The "risk" of repeat offenders returning to Live is also bullshit, because no doubt anyone seriously addicted to the service will return on a new XBox anyway.

    Hardware support is a different issue entirely. Questionable to non-existent warranty support is naturally inherent to buying used electronics, but the online service should not be inextricably tied to the device's warranty.

    This has been the policy since BEFORE the initial Xbox Live rollout in 2002. The beta testers (myself included) got a ban for mod chips. The Xbox was flagged, even if the mod was removed, it was banned.

    Same thing held true with Softmods. I know there are more reasons for a ban now, but the policy has always been once a unit was banned, you could not unban it. #xbox

    Seems incredibly wasteful to ban *hardware*. After all, it was the user that violated MS policy, not the xbox.

    If MS really cared about anything other than money, it would ban specific users instead of their xboxes, but a banned user can't pay the monthly fee... #xbox

    @bluespot: No, because then that user would just sign up for another account. Banning the xbox 360 is the only way to ensure that user won't get on anymore. It does make sense, though it sucks for people who buy the broken xbox. #xbox

    interesting I got a used Xbox from e-bay worked for a week broke and I sent it back in and got one back in fact they sent me 2 by mistake and it was harder to return the second one than it was to get the used one fixed #xbox
