<P>FreeMan, Please eloborate on tinkering. If you are talking about adding aftermarket items for performance or other wise then you are totally incorrect! The magnusson moss warranty act states that the part or parts must have caused or contributed to the cause for which warranty work is sought. The manufacturer can't deny your warranty simply because aftermarket parts are present.</P>
<P>This may apply to the iphone as well.</P>
<P>People of this bricking iphone issue should research the magnusson moss warranty act because it covers any warranty issued by any manufacturer. The modified firm ware didn't cause any harm to the iphone so how can they deny your warranty. Just a helpful tip, though I don't know much when it comes to this sort of issue.</P> <p>kidnkorner</p>]]></description>

		    <description><![CDATA[<p>I'm an Apple hater, but this comment will be objective:</p>
<p>Here's the ULTIMATE ANSWER to the question: "Whose fault is it?"</p>
<p>1. Apple created a product that happens to come with a certain EULA which you must agree to before using their product. They are a business, and as such, can put whatever the hell they want in their EULA, because you still have a CHOICE to refuse it and NOT USE the product! CYA: Cover Your Ass, and Apple did. And they have a right to.</p>
<p>2. You bought an iPhone: YOUR CHOICE. If you don't like what happens as a result, well you could have bought something else. No one forced you to spend the money. You also agreed to the EULA previously mentioned. YOUR CHOICE.</p>
<p>3. You downloaded an unlocking program. You put this program onto your iPhone. YOU RAN THE PROGRAM. So far, every choice up until now has been made by YOU, and EXECUTED by YOU.</p>
<p>4. Apple came up with a firmware update which they claim "makes the iPhone better" in some way, shape or form. And since they are the ones who invented it (and you are the one who agreed to their EULA), they can provide whatever the hell firmware update they want (as long as, by THEIR definition, NOT YOURS, it makes the iPhone more "functional", again, defined by them, NOT YOU). As it should be, as every business has a right to make it so.</p>
<p>5. You had a choice: install the firmware update, OR NOT. Despite warnings everywhere on the Internet and elsewhere: You EXECUTED THE PROCESS TO COPY THE FIRMWARE TO YOUR IPHONE. YOU RAN THE FIRMWARE UPDATE. Apple just provided an OPTION to download said update. YOU INVOKED IT.</p>
<p>If you modded your phone and got screwed, it's on YOU, NOT APPLE.</p>
<p>That's life, and the world of business. Don't like it? DON'T BUY THE PRODUCT. The world owes you nothing, and neither does Apple (as much as I hate them and would love to see them out of business).</p>
<p>An analogy to leave you with, that's actually FITTING to the situation, unlike a lot of them out there about cars and nonsense (this one makes sense, as you'll see):</p>
<p>You buy an iPhone, and you throw it against a wall (your choice as to whether you want to or not, and people do warn you). It shatters into a million pieces. Is Apple supposed to reimburse you for something you CHOSE to do? No.</p>
<p>And the above analogy works because it's based off choice. Apple DID NOT FORCE YOUR FIRMWARE UPDATE TO RUN. Even if it forced it to download, it did not run the update itself, and therefore you did.</p>

		    <description><![CDATA[<p>Apple's actions were deliberate and malicious.  Apple's firmware update could have easily detected hacked and unlocked iPhones before installation and said, "Sorry, you have violated your warranty.  No more updates for you.  Have a nice day."  That would have been the civilized way to handle this.  Instead Apple decided to "teach their users a lesson" and destroy their iPhones.  That's just disgusting to me, and I have an iPhone and I love Apple computers, so this is a real shame.</p>
<p>When you think about it, the iPhone really is just a hand-held finger computer.  All you people who are defending Apple's malicious actions would be pissed as hell if they disabled your Macbook because you installed some software on it that Apple Corporate didn't like. <P>If you get a any product and change it to operate differently from how it was designed... let's call it hacking the device regardless if it is a tech or not.  If the device is then rendered inoperable is is wholly on the modifier... point blank.  Stop bitching at Apple or anybody elese for you trying to buck the system... Even if the system is flawed.. it is still the system.</P>
<P>In most states it is illegal to spit on the sidewalk but we all do it.  If you ever get caught it is on you because we all choose not to follow the rules aout spitting ... i know its off topic but it is kinda parallel in concept.</P>
<P>As consumers if you want to remain a Tmobile or Sprint customer then you can only consume the wares that they offer.  Period... McDonalds will not sell you sushi and you cant hack a fish filet to resemble sushi.</P>
<P>Grow up and take responsability even if it means you cannot have a Jesus  Phone.</P>

<p>Dear Genius:</p>
<p>Learn to read and understand comments in context.</p>
<p>A commenter had taken (in my opinion) excessive umbrage at the term "Indian Giver" in a rather histrionic manner.  In retort, I said, "Maybe they feel gypped. I'm sure, with enough patience, any customer can Jew a free repair out of Apple."</p>
<p>Let me explain to you a bit of my family history.  I am Jewish.  My mother is Jewish.  My father is Jewish.  My maternal grandmother is Jewish, as is pretty much every member of my family, except for the occasional gentile who has married into the family.</p>
<p>In the Twenties, my maternal grandfather's side of the family came to America from Poland.  Around that time, my paternal grandmother's family came to America from eastern Germany by way of England.</p>
<p>In the mid-thirties, after Hitler had been named Chancellor, my paternal grandfather came to America, because he, like many German Jews, saw the proverbial writing on the wall.  In January of 1942, he tried to enlist in the Army, but was turned away because he was originally from Germany.</p>
<p>About a year and a half later, he was drafted.  When the Army wised up and saw that he could translate, he was put in the front lines to help liberate concentration camps.  He was one of the first to help liberate Auschwitz.  His squad captured an SS guard.  He asked the guard, "How could you do this?  How could you kill these people?"  The guard replied, "They weren't people; they were Jews."  My grandfather handed his machine gun and his sidearm to a squadmate and proceeded to beat the SS guard to death with his hands.</p>
<p>My grandfather believed strongly in freedom - freedom of religion and freedom of speech.  On more than one occasion, he exercised his freedom in a manner that probably best be described as "being a dick."  He got into a feud with his neighbors in an apartment complex in Jerusalem in the mid 60's, and, just to piss them off, fried up a pound of bacon on a Saturday.</p>
<p>Knee-jerk reactions to comments taken out of context leads to a tyranny of stifled expression.  True democracy comes from the free exchange of ideas and often involves people being offended.</p>

Apple damn well new about the hack and knew how many people this would affect. They could have just relocked all of the phones remotely with new software and encription, but no they decided to break the phones that were working. Who's phone is it anyway?? That's rediculace, that's like verizon turning off data bluetooth on razors so you have to buy ringtones from them even if you already own the rights to the music. <P>As an iPhone owner and a hardware hacker, I can't believe the crap being spewed by gizmodo about the firmware update. <BR>
You are aware that FW updates to a hacked xbox will prevent the system from being used on Live! right? The last phone I had was a Cingular/AT&amp;T 8525/HTC Tytn, in the last year it was hacked to run WM6. AT&amp;T and HTC both refused to supprt hacked phones. I've read countless accounts of bricked tytn's that cost users to get fixed. Unlocking an iPhone and the firmware update are *BOTH* the users choice and controlled outside of any support responsibility Apple has for its products.</P>
<P>Gizmodo comes along and calls Apple "Indian Givers"  because they won't support something that the product wasn't meant to do. Enough already. The iPhone is a great product. If you have to mess with it, don't blame apple for the issues.</P></BR> <p>unsigned1138</p>]]></description>

If a normal user wants to buy it at six hundred bucks, ok. Do it. <P>We may eventually see some third-party apps for the iPhone but I believe Apple will insist on an closed Nintendo style system where all software has to be published through iTunes after being certified by Apple or sold separately after receiving the Apple certification badge.</P>

		    <description><![CDATA[<p>I'm really interested how all of this will play out when it comes to Europe, and specifically the UK. We have laws over here to protect consumers from behaviour like this. If an update is released by the manufacturer, regardless of whether the owner has made any changes to the software, which 'bricks' the phone then the company is legally obligated to repair or replace the item within its initial warranty period (which in the UK, on something like a phone, is legally required to be 12 months minimum).</p>
<p>The difference between the UK and USA seems to be the concept that a hardware device can come with an EULA in the USA. Whereas over here it can't.</p> <p>localzuk</p>]]></description>

Christ, do you know how much of a CHORE it would be to write a program to keep your computer from booting up and accepting an OS install?  Sure writing to the cmos can keep it from booting, but I'm willing to bet the iPhone does not require any information in the programable portion of it's bios to be working properly for itunes to flash it.  The portion that allows it to be flashed ought to be in a non-writable portion of the memory that can executed via itunes BEFORE any writable memory block is accessed and loaded.  Simple.</p>

<P>Good to hear Microsoft has started including a warranty with Windows software. I would think that would be a bad idea. You know, with all the third party software out there the will definitely mess up windows, their tech support people will be formatting a lot of PC's. (Microsoft has no warranty on Windows OS, so you can go ahead and hack your ntkernel.exe without having to worry about MS bricking your PC.) Maybe Apple should take a page from Microsoft on this one. Or not… whatever.</P>
<P>I do agree with your point though. If you use anything in such a way as it was not intentioned, you run the risk of loosing the use the above said "anything".</P>

		    <description><![CDATA[<p>Apple is playing you all for suckers! How many updates have Apple put out for the iPhone BEFORE this that didn't brick the phone? How bad are their programmers etc if they can't make a firmware that DOESN'T brick a phone because it has 3rd party hacks? Not very good if that is so!</p>
<p>Now I doubt they've hired ppl from the bottom of the tech barrel, so it's logical that yes they bricked your phones ADN they did it on purpose! It's obvious that the ffirmware targets phones that exploited the well-publicised exploitations taht allowed teh hacks and unlocks. I pity da fool!</p>
<p>Word of advice to the Hacker Community - next time you unlock something don't go publishing the hows and who's of it. Keep it SECRET so that some Apple employee/Jobsy slave posing as hacker22 can't use the info and do this sort of thing.</p> <p>MMFY</p>]]></description>

If I install unsupported software on my computer, and then I do something like a Windows update, the Windows update may over-write the software I installed and that software won't function anymore. 		    <description><![CDATA[<p>This is a lot more simple that most of you are making it... Apple's update sees the hacked firmware, then it proceeds to break the phone - "break" means waves it's finger at you and says that it no longer works.  BUT, OBVIOUSLY, the phone still works, it boots and tells you that it's broken.  Like the guy says, it's a computer.  It sees that it's been hacked, so why doesn't it just reinstall everything back to a genuine Apple config?</p>
<p>Hey Apple and Stevsie, don't make a "revolutionary device" and expect people not to try to push it to its fullest capabilities.  They're not going to just sit there and wait for web 2.0 apps to load (zzzz).</p>
<p>I have not unlocked my phone.  I do have 3rd party native apps that I'm NOT willing to give up.   THEREFORE,  no itunes store for me!  It's pretty easy.  Keep me as a ATT customer, or lose me as a potential itunes store customer.</p>
<p>If this keeps up,  I don't really have a problem shelling out the contract cancellation fee (att) and move on to another provider (AND I'm happy with ATT so far).</p>
<p>I feel like taking my $100 rebate and buying something and then just smashing it in the store. This ordeal is almost as bad as the price drop.</p>

<p>i did however, sell all of my apple stock today. I have been an apple guy since the late 90's, and i spend entirely too much money on apple gear, as well as other gadgets. I am obsessed. People like me, the early adopter, are the ones that matter most. the ones that pay a premium for the new stuff. that early adopter premium is pure net profit to a corporation. The people that read giz all day long influence the other people that dont. We are the people that everyone else comes to for advice on these tech things. I wont be buying any more apple gear, and i wont be advising my family or friends to either. Apple is quickly becoming the new sony, and i have advised against buying anything sony for years. I probably have spent nearly ten grand per year on apple stuff alone in the last 10 years, and i have advised people to spend much more, but not any more.</p>

<p>Firstly, Apple never slandered any developers. I'd like to see which legal troll comes out of the woodwork to make such a goofy claim.</p>
<p>Secondly, Apple has no control over the source and nature of unauthorized applications loaded onto the phone, thus cannot guarantee that your phone will operate properly upon installation of these applications. If your phone bricked after the firmware update but your phone was unmodded, then I can see the big problem, if your phone bricked after the update and you had third party stuff crammed into it, you don't really have much to bitch about, especially since you were all specifically warned that this would happen.</p>
<p>As previously suggested, play dumb, and keep your trap shut. A bricked phone won't show you what you did to it software-wise, and even an unmodded phone can brick.</p> <p>Kaiser-Machead</p>]]></description>

<p>Apple didn't say that the 3rd party stuff bricks a phone.  They said that they aren't responsible for any issues that an update might cause.  It's clearly against the TOS to install a 3rd party app.  They aren't hiding that fact.  They actually came out and said this was gonna happen last week.  Anyone who tries to sue Apple isn't gonna get very far.</p>
<p>What they could do is come out with a firmware that will bring the phone back to normal.  This is a software bricking that can be corrected.  So if Apple does fix the phones via software you'll be at square one bitching about how you can't use it on other carriers.  (I hate the cell phone market as much as anyone else, but let me just ask one question.  What's cheaper, paying the $200 to get out of a current contract and hop on AT&amp;T, or buying a phone, bricking it and having to buy a new phone?)</p> <p>BurstAneurysm</p>]]></description>

		    <description><![CDATA[<p>Admittedly, it sucks that the update bricks the unlocked phone.  (Jailbroken ones are fine though, I updated my AppTapped phone and it did fine.)  The fact is, you always run a risk when you hack firmware.</p>
<p>The thing is, this is a very un-apple thing to do.  Are they going to stop warrantying a macbook because you installed a 3rd party app?  No.  The simple fact that this update is killing the unlocked phones leads me to believe that AT&amp;T was breathing down Apple's neck to eliminate the problem.  Apple doesn't care if it's exclusive, if someone wants to buy a phone to use on tmobile, that's just another $400 in Apple's pockets.  AT&amp;T is the only one suffering from the unlock.  If anything, be mad at them instead of Apple.</p>
<p>So yea, the end result is that Apple bricked your phone... but you should've seen it coming.  Hell, there's even a warning in updater 1.1.1 stating that your phone won't work if you unlocked it.  It's in bold type people, they weren't hiding it from you.  Even if you went through with it, the last thing you wanna do is go in to the store and tell them that you cracked it (knowing full well that it breaks the TOS) play dumb and just say something went wrong, you might have better luck.</p> <p>BurstAneurysm</p>]]></description>

		    <description><![CDATA[<P>i think it is not THAT easy. one thing is to unlock the phone so that you can use another provider. bad thing. but what is so bad with running your own software on it? if you run a program to install other applications like a drawing program or another game - what is the problem here? my problem is that apple willingly bricks the phone. it is as if they feel like the god, and the stupid earthling has to feel gods force, if it does bad. however, apple is now working against their customer. imagine if microsoft would have "locked" your pc, if one "illegal copy" of any program would run on windows? lock! away it goes! or what if smart car - who told me to make their service - will work out that I changed the lamp and the brakes on my own - would they brick my smart? imagine they'd do this... a company would only do this once.</P>
<P>however, the real reason behind all that is that apple wants to generate money out of the customer. the customer has to pay a much higher phone bill, the phone itself is expensive, even boring ringtones cost extra etc etc. I am a bit scared where that might lead to one day. it seems like there is no end, apple turns out to be more and more clever in how to generate money.</P>
<P>who would have thought that an ipod game will not work on another ipod? jobs forced us to buy it twice. maybe you can dump ringtones on another iphone? maybe one day apple will force the user to automatically buy all (self importet) mp3s in your itunes library, otherwise your whole itunes library will "brick"? i always thought that such behaviour will never come with apple. but now i am not sure anymore...</P> <p>Bodypainter</p>]]></description>

<p>This kinda sucks for the people who bricked their phones but won't hacker support be out very soon? I mean the way it normally works is as soon as something if "fixed" they find away around the fix. I mean look at the PSP for all examples. Every time there was a new firmware out, it would only take a few days to "re-hack" the system. 		    <description><![CDATA[<P>i think there can be away you can get around this... there has to be a way for apple to fix your phone if it doesnt turn on... and.. if you open it, and disconnect the battery and put it back together, i think that would be a reason for them to give you a refurb right at the store... or if you put your phone in water, wait till it stops working, and pay for the repair (around $150)..</P>

		    <description><![CDATA[<p>I have added games to my blackberry...is that a hack.  The unlocking of the iphone is a problem for apple, since they have an agreement, but that doesn't necessitate them bricking a phone so it is unusable. Apple is NOT greatful or respectful to their customers and those who have helped them rise in market share (read: stock market). I don't know if I can buy mac again...</p>

		    <description><![CDATA[<P>Companies offer warranties because they stand behind their work. If a product hits the market and is subsequently altered in a material way (i.e., rewriting code), the desire to stand behind the product is understandably diminished because the company no longer has contorl over the work. The law recognizes this simple fact and does not require companies to warranty products that have been materially altered (or at the very least companies are allowed to disclaim warranties for such alterations).</P>
<P>I find it interesting that when Nintendo delivered an arguably defective product (inadequate strap) people cried crazy foul over the ensuing litigation, but here, where Apple is well within its contractual rights and likely its rights under the UCC (Federal Magnuson-Moss Warranty Act) and state warranty laws, people are calling for blood. 		    <description><![CDATA[<p>I'm not agreeing with what Apple's doing here, but has anyone stopped to think of other parties involved here? Namely AT&amp;T. No one here know's what's going on behind the scenes regarding contracts between AT&amp;T and Apple. Apple's just the one with the target on there back. I'd like to see some research into AT&amp;T's hands in this whole mess. Apple is just sitting back collecting cash for iPhone sales locked or unlocked, it's AT&amp;T that looks to lose big if iPhones are unlocked.</p>

		    <description><![CDATA[<p>I have looked at Gizmodo everyday for the past few years.  Everyone's article or comment is helpful and knowledgeable.  My experience with computers (Apple) is extensive.  What I don't understand is that the most obvious has not been suggested yet.  Unless it is a lie caught on tape, the Apple employee said, "There is nothing wrong with the phone, it is just a locked sim."  I have been reading that people are trying to put a new sim card in to fix the problem.  This may seem silly, but has anyone tried to call AT&amp;T.  I once locked my pin on a RAZR.  I could not use it.  That too became a brick.  AT&amp;T sends a signal after verification of the phone, and presto an unlocked SIM.  Maybe it would be helpful (if true) to not mention that the locked sim is your fault.  If never an AT&amp;T customer, maybe the old, I messed up, please unlock the sim but don't create an account.  I want to let my spouse receive it as a gift."  When unlocked, dock the iphone and try a restore at that point.
