I've never seen the sense of raising the taxes of those who sign my paycheck, besides, every time we lower taxes, we bring in more money due to an expanding economy, and less sheltering of income. Just realize that anytime you root for a tax increase on the "evil rich," you will end up paying it one way or another (and will get no benefit of whatever government boondoggle for which it was ostensibly paying). It's more a matter of common sense than politics.

GadgetPlay

@drewls: Yeah, my Grandfather told me that with many people, when young and don't have anything (since you haven't worked and accumulated any wealth) they are a Democrat. They don't have anything and they feel that people that have it should share it with everyone else. Then, when they get older and wiser, they have managed to earn more and save more. It is then that the Government starts to take things from you and you realize just how silly it is, so you become a Republican.

I'm all for social programs and such, but the tax system we have now sucks b@77$. Everyone should be taxed the same regardless of the income they make. If they can be smart enough to make it, why penalize them for it?! Corporations get WAY too many breaks, but they do have to pay twice the Witholding tax against their employees.

This whole thing needs a big overhaul, IMO.

BigDanInTX

All this will do is hurt online retailers. The cost of living there is so high, it's no surprise their residents turned to the internet for a little cost savings. Just like the Federal Government shouldn't raise taxes to pay for their crappy programs, State governments shouldn't either.

I'm inclined to believe that this law was passed not to hurt Amazon, but to encourage business in the state by leveling the playing field. If you have a business in the state and your potential customers have an alternative that doesn't charge sales tax, then you are at an unfair disadvantage.

This isn't changing the law to say that you now have to pay sales tax for internet purchases - it's changing the law to say that you still have to pay sales tax, but now it's being collected at the time of purchase.

I don't think it's a Democrat v. Republican issue at all. It's New York government confronting the problem that internet sales are not being reported for taxes. And it's frustrating, but in a way similar to being caught speeding in a place where people speed all the time.

joestoner

If the seller doesn't collect them (which they won't, if they are out of state), you are supposed to declare your tax liability on your state income tax filing. But since none of you do (cheaters! cheaters!), your state government is trying to manipulate and control interstate commerce (which this document called, "The Constitution of the United States of America", which just so happened to be signed by the State of New York, says only the federal government is allowed to do).

But, you're saying that you shouldn't have to pay the 8.375% more for the things you buy. Just because Amazon doesn't collect the tax doesn't mean that NY allows you not to pay it.

Sure, you can ignore the sales tax for out of state purchases box on your NYS tax form, but that is technically breaking the law, and definitely unethical.

And yes, go ahead and say that "no one pays it anyway." Go on believing that so that you can feel better when you don't put anything in that box.

smcallah

One thing to remember is that on the "user" end, this isn't an inherently new tax.

When we file taxes in NY, we essentially have a duty to disclose online purchases and make up the sales taxes at that time. This may come as a little bit of a surprise, but it turns out it's really hard to enforce the tax after the fact.

Rather than being a new tax, this, arguably, merely moves the time of taxation from April 15 to the moment of transaction.

(Although it's still unclear to me whether making it a sales tax rather than a user tax is Constitutional. I could see it coming out either way.)

@LastAndLeast: Only a crazy person would follow anything I say here as advice. (For example, I happen to believe in taxes. More and more taxes. More congestion pricing! More teachers per student! More improvements on the city's sewer lines! More Mass Transit! More Health Care! More, more, more! Out of my pocket and into the public till!)

I was merely enjoying the irony.

(But I still think Amazon is perfectly within their rights to fight this.)

92BuickLeSabre

The law could be unconstitutional.

According to the constitution, states do not have the right to regulate interstate commerce. States can only regulate intrastate commerce within its own borders. Technically, Amazon is an out of state merchant conducting interstate trade with New Yorkers. Hence the law is arguably unconstitutional.

ny355145

How is this different from other states that charge sales tax on items shipped into their state? Hell, when I lived in Rhode Island, who's sales tax was 7%, we were supposed to pay the difference between that and the 5% we paid for stuff in Massachusetts each year on our state tax returns. Now that's messed up!

rsquared

Well, this is the way government works, federal or local. They think there some sort of business. And the only way to get more money from the people is well.. to tax. That's the only way they can make a profit.

Anyways, I already pay this tax in my state. It sucks. I hate it. But honestly in the end.. nothing I can really do about it.

All I can say is I hope that Amazon wins. Just for the pure fact I hate excessive taxing. And anytime that someone wins and doesn't have to pay more taxes. Well that's a great day indeed.

-Core-
