Well, one person already has, filing a suit against Apple claiming that iPods are inherently defective in design and are not sufficiently adorned with adequate warnings regarding the likelihood of hearing loss. Despite the fact that Apple does, in fact, put warnings on iPods telling you not to listen at high volumes, the suit seeking class action status, of course demands that Apple pay up.
