The Contest is currently titled "RadioShack/Gizmodo Lollapalooza Contest" (the "Contest") and is scheduled to commence on July 1st, 2011 and end on September 30th, 2011.
The Contest is open to legal residents of the 50 United States or the District of Columbia who are 18 or older at time of entry. Employees of Gawker and RadioShack ("RadioShack"), and their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies and their immediate family members (defined as spouse, siblings, parents and children) and/or those living in the same household (whether related or not) of each are not eligible to enter. Contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law.
Participants will enter the Contest by visiting the Gizmodo website (www.gizmodo.com) and filling out and submitting a Contest entry, in which a Participant will need to provide his or her email address and a video submission,.
Entries must be received by 6 PM ET on July 26th, 2011. Limit of one (1) entry per person per email address. Entries received from any person or email address in excess of the above stated limitation will be void. Entries generated by script, macro, or other automated means or by any means, which subvert the entry process, are void. All entries become the property of Sponsor and will not be returned.
To be eligible, an entry must (i) be entrant's own original work, (ii) not be previously published or submitted in connection with any other contest, (iii) be in keeping with the Sponsor's image; and (iv) not be offensive or inappropriate, as determined by the Sponsor in its sole discretion. Sponsor reserves the right to disqualify any entry that it determines, in its sole discretion, is offensive or inappropriate, not in keeping with Sponsor or RadioShack's image or that is otherwise not in compliance with these Official Rules.
By submitting an entry, entrant hereby grants permission for the entry to be featured on Sponsor's websites and/or RadioShack's websites. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of entries by third parties. Released Parties do not guarantee the posting or use of any entry.
By submitting an entry, each entrant agrees Sponsor and RadioShack shall own the entry submitted (including the copyright thereto and all rights embodied therein) and that Sponsor [and RadioShack] and their respective designees may exploit, edit, modify, and distribute the entry and all elements of such entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or hereafter devised, worldwide, in perpetuity without compensation, permission or notification to entrant or any third party.
There will be one (1) winning entry among all eligible entries received during the promotion period. The person with the one winning entry will receive the following Prize: round-trip airfare and hotel stay for one (1) person to Chicago (if required) to be provided by Gizmodo, one (1) VIP ticket to Lollapalooza to be provided by RadioShack, one (1) VIP pass and ticket to one after-hours show to be provided by RadioShack, and various items supplied by RadioShack. Total ARV of the Prize is three thousand dollars ($3000 USD). Any expenses not mentioned above are the winner's responsibility, including, but not limited to, all federal, state, and local taxes. Prize is not transferable or redeemable for cash. No substitution for Prize except at Sponsor's sole discretion as may be necessary due to unavailability, in which case a prize of comparable or greater value will be awarded, at the Sponsor's sole discretion. All prize details are at Sponsor's sole discretion.
Eligible entries will be judged by a panel of qualified judges, as selected by the Sponsor (the "Judging Panel"), who will select one (1) winner based on the following judging criteria: (1) originality of the submission, (2) creativity of the submission, and (3) overall structure, composition, and quality of the submission (the "Judging Criteria"). The one (1) submission that ranks the highest based on the Judging Criteria as determined by the Judging Panel will be deemed the Contest winner. In the event of a tie, an additional tie-breaking judge will determine the winner from among those tied using the Judging Criteria. Sponsor reserves the right not to award all prizes, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified submissions. Limit of one (1) winner per household.
Potential winner will be notified by email to the address from which the submission was provided and may be required to complete an Affidavit of Eligibility and Liability/Publicity Release which must be returned within five (5) days of the date on the notification letter via a prepaid return envelope provided. If a potential winner cannot be contacted, does not comply with these Official Rules, or any prize notification letter or prize is returned as undeliverable, the prize will be awarded to a runner-up as determined by the Judging Panel, in Sponsor's sole discretion. Allow 4 to 6 weeks after validation for receipt or arrangement of receipt of prize. You are not a certified winner until validated and you receive official notification from the Judging Panel.
Entrants agree to be bound by these Official Rules and Gawker Media's Standard Contest Rules (http://advertising.gawker.com/legal/contest-...). Prize acceptance constitutes permission (except where prohibited) for Sponsor to use winner's name, photo, city, state, likeness and entry (in whole or in part) for promotional, advertising, and publicity purposes in any and all media now or hereafter devised, worldwide in perpetuity, without additional notification, permission, or compensation. Participants, by participating in this Contest, hereby waive and release, and agree to hold harmless the Sponsor, RadioShack, and their respective parents, subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, "Released Parties"), from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of a prize in the Contest, or their participation in the Contest, or their participation in any Contest or prize related activity, or any travel related to the Contest, or any travel for any prize related activity, and for any and all claims based on rights of publicity and/or privacy. Released Parties are not responsible for lost, late, misdirected, undelivered, delayed, damaged, incomplete or garbled entries or emails; or for lost, interrupted or unavailable network, server Internet Service Provider (ISP), website, satellite, or other technical, hardware, software, telephone, or transmission failures of any kind, which may occur in connection with the administration of the Contest, the announcement of the prizes, the processing or judging of entries, or limit to a person's ability to enter the Contest.
