US District Court judge Lynn N. Hughes has struck down a recently-passed law that would have allowed law enforcement to obtain cell phone records without a warrant. Sorry Feds.
In his one page decision brief, Hughes states, “The records would show the date, time, called number, and location of the telephone when the call was made. These data are constitutionally protected from this intrusion.”
This is just the latest in a series of setbacks in the government’s attempt to monitor suspects. The US Supreme court is currently listening to arguments in a case where officers are accused of covertly installing a GPS tracker on a suspect’s vehicle and tracking him for over a month.
