Porn in Texas comes under House Bill 1181, in force since September 2023. The Supreme Court settled the constitutional argument in June 2025. As of September 2026, 27 states require an age check before a porn site opens, and the Supreme Court has already upheld the Texas version. For a legal adult in Texas, the result is a verification step, a document sent to a company you didn’t pick, and a privacy problem the statute leaves unsolved.

What House Bill 1181 Requires

HB 1181 became Chapter 129B of the Texas Civil Practice and Remedies Code. A commercial site falls under it once more than one-third of what it publishes is harmful to minors. Each covered site has to establish that a visitor is at least 18. 3 methods qualify: a government-issued photo ID, a digital identity check, or a commercially reasonable check against public or transactional records. The law was due to take effect on September 1, 2023, and a federal judge blocked it the day before.

It became enforceable on March 7, 2024, when the Fifth Circuit lifted that block. The same ruling struck down one part of the bill. The court also kept the injunction on the state health warning Texas wanted porn sites to display, calling it compelled speech. Penalties go up to $10,000 a day. A site that keeps identifying information after granting access faces another $10,000 a day, and a $250,000 penalty applies if a minor accesses the material. The Attorney General brings the cases.

Every obligation in Chapter 129B is for the website. A Texas resident who visits one breaks no part of the statute, and the text requires no step from the visitor.

Is Porn Banned or Illegal in Texas?

No. Watching porn in Texas is legal for adults over 18, and the state didn’t prohibit pornography. Texas made access conditional on proof of age, which is a different thing from a ban, and the difference explains why some sites still open in Texas while others do not. No. Chapter 129B defines its obligations by the website, and the words VPN, proxy, and IP address appear nowhere in it. The Supreme Court Ruling Behind It

The Supreme Court decided Free Speech Coalition, Inc. v. Paxton on June 27, 2025, and Texas won 6-3. Justice Thomas wrote for the majority that HB 1181 passes intermediate scrutiny because it burdens adult speech only incidentally. The Supreme Court declined to freeze the law on July 6, 2026, denying two emergency apps without ruling on the First Amendment, and the Fifth Circuit heard the merits argument on August 4, 2026. Where the Other States Stand

Louisiana’s law came first, in January 2023, and 27 states now require verification before a porn site loads. Iowa’s law took effect on July 1, 2026, and Missouri’s followed on August 28. No court is currently blocking any of the 27. Utah extended its statute to cover residents whose traffic exits a server in another country, which no other legislature has yet copied.

Ohio wrote an exemption for interactive computer services into its law, and an Attorney General review found only 1 of the 20 most-visited porn sites verifying visitors. Abroad, the UK requires checks under the Online Safety Act, France saw Aylo withdraw over the same fight, as Journal du Geek reported, and Australia has its own version in force.

Conclusion

One thing changed in Texas during 2026, and it was not the statute. Porn sites in Texas still verify or leave; Aylo has still not returned, and Chapter 129B still asks nothing of the person visiting. The second layer moved. Since June, Apple and Google have verified ages at the account level under SB 2420.

Verifying means a license, a passport, or a face scan sent to a vendor with its own security record, and the ban on keeping that data is an instruction with no mechanism behind it.
